Supreme Court Upholds Biden Administration’s Limits on ‘Ghost Guns’

In a landmark decision, the Supreme Court has upheld the Biden administration’s limits on so-called ‘ghost guns.’ These homemade firearms, which are typically assembled from parts purchased online and do not have serial numbers, have been a growing concern for law enforcement officials in recent years due to their untraceability and potential for use in crimes.

The Biden administration’s rule, which was announced in May of this year, requires individuals who want to build their own guns at home to undergo background checks and register their firearms with the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF). This move was seen as a necessary step to close a loophole that allowed individuals to easily skirt existing gun regulations by building their own untraceable firearms.

The decision by the Supreme Court to uphold these limits is a significant victory for gun control advocates and law enforcement officials who have been calling for stronger regulations on ghost guns. In a 6-3 ruling, the justices determined that the Biden administration had the authority to regulate these homemade firearms under existing gun control laws.

Justice Sonia Sotomayor, writing for the majority, stated that the regulation of ghost guns was necessary to protect public safety and prevent these untraceable weapons from falling into the wrong hands. She pointed to the increasing use of ghost guns in crimes across the country as evidence of the need for stricter regulations.

However, the decision was not without controversy. Justices Clarence Thomas, Samuel Alito, and Neil Gorsuch dissented, arguing that the Biden administration’s rule went beyond the scope of existing gun control laws and infringed on the Second Amendment rights of individuals to bear arms.

Despite this dissent, the Supreme Court’s decision to uphold the limits on ghost guns is a significant step forward in the fight against gun violence in the United States. By closing the loophole that allowed individuals to easily build untraceable firearms, the Biden administration’s rule will help to prevent these dangerous weapons from ending up on the streets and being used in crimes.

Overall, the Supreme Court’s decision is a victory for public safety and a clear signal that the regulation of ghost guns is both necessary and constitutional. It is a step in the right direction towards reducing gun violence and keeping our communities safe from the dangers posed by untraceable firearms.
